PUBLIC HEARING

Supervisor Hargrave called the Public Hearing to order at 7:00 p.m.  The following Town Board Members were present:

 OTHER PRESENT:  Boy Scout G. Heritage & D. Topper from Troop 5; M. Topper; D. Costanzo, Highway Superintendent  & M. DeFoe, Town Clerk.

The clerk read the legal notice as placed in the Daily Gazette on October 26, 2007 and posted at Town Hall; Library; Post Office & Bank.  Salary figures on Preliminary Budget for 2007 are as follows:  Supervisor - $13,000.00; Council Members (4) – each at $3,700.00, with Deputy Supervisor an additional $200.00; Town Clerk - $22,280.00; Superintendent of Highways - $51,500.00.  Supervisor Hargrave asked if there were any questions or comments from the audience.  There were no questions or comments from the audience. 

The Public Hearing was adjourned at 7:03 p.m.

Supervisor Hargrave called the meeting to order at 7:30 p.m.  The following Town Board Members were present:

A motion was made by Councilman Weed, seconded by Councilman Topper to approve the minutes of the October 9, 2007 Public Hearing & Regular Meeting & October 23, 2007 Special Meeting as submitted.
     All ayes.                                                                  MOTION CARRIED

Communications – Town Clerk stated that Town Board Members received copies of the following correspondence:  Assessor’s Report dated November 13, 2007; Highway Maintenance Report for October and schedule for November, along with a man hour/material list for Highway work on recreational field project.  Building Department permit report covering 10/1/07 to 10/31/07; Dog Control Officers Report for September & October; Letter from Arlene Rhodes, President of Galway Public Library Board of Trustees inviting Supervisor & Town Board to Shubert Award Presentation held at Town Hall on Monday, October 29th at 6:30 p.m. Correspondence was received from the residents of Old Mill Road requesting a speed limit reduction.  Thank you letter from Debbie & Roger LaBreche to Supervisor & Town Board for keeping Galway rural.  Copy of the Harmony Corners Fire District 2008 Budget was received from Treasurer, Lynne Gipp and available for review.  Speed limit reduction and enforcement request was received from Earl Groat for Jersey Hill Road.  The completed 2007 Town Property inventory was received from Councilwoman Sutch, available for review. 

Privilege of the Floor C. Haven, Library Director thanked Town Board for use of building for the presentation of the Shubert Award for Excellence.  Galway is the smallest community ever to win this award.  Ms. Haven gave the Town Board a copy of the speech presented by Mary Lou Caskey, member of the award selection committee, Regents Advisory Committee.  Library Board of Regents granted charter as a School District Library on October 23rd.  Library Board of Trustees dissolved as of November 6th, and new School District Board was sworn in.  Expressed their gratitude to Town Board for support of Library during transition period.  Arlene Rhodes thanked Town Board for nine years of support; providing building and maintaining building.  Arlene stated that the Town Board may still like to receive either a quarterly or annual report from Library.  She stated that the Library will be waiting to hear what the Town Board’s determination is with reference to disposition of building, and how Board sees Library using it. 

COMMITTEE REPORTS:  Assessor - No Report.  Public Safety – No Report.  Property – Councilwoman Sutch stated property inventory was completed and filed with Town Clerk.  Building & Grounds – Councilman Topper stated that grass seems to be coming up well at ball field.  Parking lot is coming along fine, thanks to material from Highway Department.  In talking with engineer, it has been determined that the crossover road for access to the 3rd field should be moved to the very back of parking lot.  This will give more grass behind the backstop; 1st base line & player’s bench.  In the future this area may be used for a concession stand or bleachers.  There is no additional cost for change.  Councilman Topper stated that it was a good idea to put drainage under new parking lot, since area seems wet.  Culvert work adjacent to old field is complete.  Councilman Topper is working on what it would take to put a walking trail around field & a basketball court somewhere in parking lot area.  Another thought he has is possibly a pavilion area, suggested possibly for a farmer’s market.  He would like input on this idea.  Supervisor Hargrave questioned status on old back stop.  Councilman Topper stated that he would contact Lion’s Club to see if they still wanted it.  Backstop was used by school when their field was down a few years back.  Removal of this backstop would make mowing easier and create a full size regulation soccer field.  Supervisor Hargrave stated that the two doors in meeting room would be replaced next Tuesday, along with removal of door in kitchen and installation of window in its place.  Supervisor Hargrave advised Highway Superintendent that the delivery of the doors & window will be this Thursday, would like them stored in old garage until Tuesday.  Public Affairs – Councilwoman Sutch stated that she attended the Shubert Award Ceremony for Library.  It was a very nice reception, Councilwoman Sutch was very proud of our community.  Highway – No Report.  Historian – Phyllis Keeler introduced Neil & Jean Cayey to Town Board for a presentation.  Jean Cayey stated that she had a large sea shell collection over the years.  When she outgrew the first display case, she donated that case to the Galway Central School which can be seen in the Auditorium entrance area.  The only stipulation she gave school was that it could not be used for sport related material.  Last year she donated her Sea Shell collection to the Delaware Museum.  She has now donated the larger display case to the Galway Historian’s Office, which she believes will be used for Joseph Henry items.  Phyllis Keeler thanked the Cayey’s for this donation, which is located in new Historian’s Office.  Phyllis would like to express her thanks to Tom Cwikala, her Deputy for his work in helping to complete the Galway History file.  Phyllis has been asked to guide a history tour for 120 9th graders for a two hour bus tour of School District.  This tour will take place on December 10th from 9 a.m. to 3:00 p.m.  Supervisor Hargrave welcomed Michelle Topper and Boy Scouts Garret Heritage & Dylan Topper from Troop 5 to tonight’s meeting.  County & Town – Supervisor Hargrave stated on a Town/County level, they have been working on budget.  On Town level, budget went down $3,000.00 from 2007 to 2008.  In total 2008 budget will increase $11,000.00.  Supervisor Hargrave is working on County budget.  He is Chairman of Law & Finance.  In January Supervisor Hargrave will be Chairman, of Board of Supervisor’s.  Thanked Town Board for work on this budget. 

LIAISON REPORT:  Planning Board – No Report.  Youth – Councilman Topper stated that Rifle Team has begun their new season with their annual safety class.  Karate has 25 students.  Youth commission will try again this winter for a x-country skiing program at Bob’s Tree’s.  Culture program will have 1st Night tickets again this year.  Supervisor Hargrave will donate another ticket for 1st  Night.  Councilman Topper stated that they are still looking for a volunteer to head up a summer culture program.  They would like to have bands on Village Green once a month for summer months.  ZBA – Councilman Weed stated that David Garrison & Carl & Brenda Horstmann were denied an area variance for relief from Section 280-a of NYS Town Law regarding frontage on a public highway.  Senior Citizens – Councilwoman Sutch stated that the Senior’s had their cover dish luncheon on October 18th , which was very well attended.  Trip to Radio City Music Hall on December 3rd is sold out.  Flu clinic scheduled November 19th from 1-3 p.m. at Methodist Church.

Councilman Topper made a motion, seconded by Councilman Weed to approve the General Abstract of Vouchers (A) dated 10/10/07 thru 11/13/07 for a total of $34,730.08.
     All ayes.                                                                  MOTION CARRIED

Councilwoman Sutch made a motion, seconded by Councilman Tillson to approve the General Abstract of Vouchers (B) dated 10/10/07 thru 11/09/07 for a total of $4,176.20.
     All ayes.                                                                  MOTION CARRIED

Councilman Tillson made a motion, seconded by Councilwoman Sutch to approve the General Abstract of Vouchers (DA) dated 10/10/07 thru 11/09/07 for a total of $44,473.44.
     All ayes.                                                                  MOTION CARRIED

Councilman Weed made a motion, seconded by Councilwoman Sutch to approve the General Abstract of Vouchers (DB) dated 10/10/07 thru 11/09/07 for a total of $155,792.49.
     All ayes.                                                                  MOTION CARRIED

Councilman Tillson made a motion, seconded by Councilman Weed to approve the Special Lighting District Abstract of Vouchers (SL) dated 10/10/07 thru 11/09/07 for a total of $131.98.
     All ayes.                                                                  MOTION CARRIED

Councilman Topper made a motion, seconded by Councilman Tillson to approve the Galway Fire District Abstract of Vouchers (GF) dated 10/10/07 thru 11/9/07 for a total of $159.04.
     All ayes.                                                                  MOTION CARRIED

Councilwoman Sutch made a motion, seconded by Councilman Topper to approve the Supervisor’s Operating Statement for the period ending 10/31/07.
     All ayes.                                                                  MOTION CARRIED

RESOLUTION # 70-2007 – 2008 Town of Galway Budget.  On a motion of Councilman Topper, seconded by Councilman Tillson the following resolution was ADOPTED BY ROLL CALL VOTE:

     RESOLVED that the Galway Town Board adopt the 2008 Budget as submitted.

RESOLUTION # 71-2007 – Request speed limit be reviewed on Old Mill Road & Jersey Hill Road.  On a motion of Councilman Topper, seconded by Councilwoman Sutch the following resolution was ADOPTED:  AYES – 5    NAYS – 0
     RESOLVED that the Galway Town Board authorize the Town Clerk to send a request to State for review of speed limit on entire section of Old Mill Road between Parkis Mills Road & Jockey Street; and also the entire section of Jersey Hill Road from Perth Road to the Charlton town line.
     All ayes.                                                                  MOTION CARRIED

RESOLUTION # 72-2007 – Determine what to do with Library Building.  Supervisor Hargrave stated that Town Board needed to determine whether to rent; sell or give building to Library.  Board went into discussion regarding this matter.  On a motion of Councilman Tillson, seconded by Councilman Weed the following resolution was ADOPTED:  AYES – 5            NAYS – 0
     RESOLVED that the Galway Town Board authorize the Supervisor to discuss with  Attorney the feasibility of selling Library Building to New Library District for $1.00; newly created Library District may remain in building rent free.
     All ayes.                                                                  MOTION CARRIED

RESOLUTION # 73-2007 – Amend Resolution # 24-2006.  When resolution was done, Town Board used the expiration month & day used for ZBA Member instead of Planning Board, should be 7/01/08 instead of 12/31/08.  On a motion of Councilwoman Sutch, seconded by Councilman Tillson the following resolution was ADOPTED:  AYES – 5   NAYS - 0
     RESOLVED that the Galway Town Board amend Resolution # 24-2006 to state the correct expiration date of 07/01/08 for term of office on Planning Board Member Michelle Morgan.
     All ayes.                                                                  MOTION CARRIED

RESOLUTION # 74-2007 – Schedule public hearing for review of proposed subdivision & zoning law update.  On a motion of Councilman Tillson, seconded by Councilman Topper the following resolution was ADOPTED:  AYES – 5            NAYS – 0
     RESOLVED that the Galway Town Board schedule a public hearing for December 4, 2007 at 7:00 p.m., to review proposed Local Law # 2 of 2007, -“Changes to the Code of the Town of Galway regarding its Subdivision & Zoning Laws”.
     All ayes.                                                                  MOTION CARRIED

RESOLUTION # 75-2007 – Schedule public hearing for review of  proposal regulating the use of Residential Outdoor Solid Fuel Burning Furnaces.  On a motion of Councilwoman Sutch, seconded by Councilman Weed the following resolution was ADOPTED:    AYES – 5  NAYS – 0
     RESOLVED that the Galway Town Board schedule a public hearing for December 11, 2007 at 7:00 p.m., to review proposed Local Law # 3 of 2007, “Regulating the use of Outdoor Solid Fuel Burning Furnaces within the Town of Galway”.
     All ayes.                                                                  MOTION CARRIED

Councilman Tillson made a motion, seconded by Councilman Topper to adjourn the meeting to Executive Session to discuss pending litigation at 8:18 p.m.
     All ayes.                                                                  MOTION CARRIED

On a motion of Councilman Topper, seconded by Councilman Tillson the Town Board returned to Regular Session at 8:33 p.m.  Supervisor Hargrave stated no action was taken by Town Board during Executive Session.
     All ayes.                                                                  MOTION CARRIED

Councilman Tillson made a motion, seconded by Councilman Topper to adjourn the meeting at 8:34 p.m.
